The Chapter 13 public accessible window and lobby payment drop box is CLOSED until further notice. All Chapter 13 plan payments must be mailed in or submitted automatically via the TFS payment system.

- All 341 Meetings of Creditors will be conducted by telephone or video-conference. Additional information as to how that will work will be forthcoming. For now, there will be no in-person 341 Meeting of Creditors.

The U.S. Bankruptcy Court for the Eastern District of California has issued Coronavirus-related guidance on their website which you may visit by clicking this link.
For cases with Chapter 13 Trustee Russell Greer:
- As of this update, the payment drop box at the Trustee’s office remains open.
- The trustee is evaluating whether or not and how to modify the default provisions of confirmed plans. This means that if your income is reduced and/or your ability to make the plan payment is impacted by your employer closing or if your are self-employed and you cannot work, earn money, or receive income, the trustee is evaluating whether he will modify the procedures for when a plan is in default for lack of payment. At this time, all schedule payments are due by the regularly scheduled date.
- All 341s that were previously scheduled for Modesto on March 25 and April 1 are being continued to April 15 or 22 and those previously scheduled for Sacramento for March 26 and April 2 are being continued to April 16 and April 23. For those cases where no 341 meeting has previously been held, amended 341 notices will be generated by the trustee’s office today. For those cases where 341 meetings were previously continued, the trustee’s office will send notices of the change of the continued date and amending the 341 report previously filed.

The Coronavirus has caused many businesses to close which in turn will reduce or eliminate income for many of my clients. This will likely have a significant impact on many people’s ability to make the monthly plan payment of their Chapter 13 reorganization plans.
There are no measures or guidance from the U.S. Bankruptcy Court for the Eastern District of California. The U.S. District Court for the Eastern District of California has issued guidance on their website which you can visit by clicking this link.
There are no procedures in the model Chapter 13 reorganization plan that provide for a situation such as the Coronavirus pandemic. The typical model Chapter 13 reorganization plan provides for monthly payments due by the 25th. There are no provisions in the plan which allows for payments to be missed.
If plan payments are missed, the plan will be in default. Eventually, the trustee will file a motion to dismiss. In such an event, a modified plan can likely be filed which deals with the missed plan payments.
